What to expect when FILING A REPORT

Reporting to Police

鶹ԭ encourages individuals to report sexual misconduct to local police. Timely reporting is crucial for investigation and prosecution and may lead to an arrest or aid other cases.

Individuals have the right to choose whether to file a police report. Filing may prompt investigation and prosecution, but does not obligate the individual to testify in court.

What to expect when REPORTING AN INCIDENT TO 鶹ԭ

Reporting to 鶹ԭ

鶹ԭ has designated a Title IX Coordinator to oversee sexual misconduct complaints. Individuals may choose whether to report to the Title IX Coordinator or Deputy. Both are trained to assist reporters and provide information on resources, services, and interim measures or accommodations.

All 鶹ԭ employees, including student employees, must report any sexual misconduct they learn of. Only the director of counseling can offer complete privacy. Title IX Coordinators handle complaints sensitively and securely, but full privacy cannot be guaranteed.

To file a report:

Electronic and Anonymous

You may also file a complaint online. Anonymous complaints are accepted, but 鶹ԭ ability to investigate is limited. Use this form to report sexual misconduct: 鶹ԭ Sexual Misconduct Reporting Form.

Suggestions regarding PRESERVING EVIDENCE

Preserving Evidence

Whether or not an incident is reported to police or the college, 鶹ԭ encourages preserving evidence. This helps protect all future legal options.

Below are suggestions for preserving evidence in a sexual misconduct incident. Not all suggestions may apply to every situation.

General Suggestions

Do not alter, dispose of, or destroy any physical evidence. If a drink may have been drugged, notify medical personnel or law enforcement immediately. They can collect possible evidence from the drink or through a urine or blood sample.

Preserve electronic evidence: save or screenshot text and instant messages, social media, and keep pictures, logs, or relevant documents.

Even if an individual chooses not to file a complaint regarding sexual misconduct, they should consider speaking with law enforcement. This can help preserve evidence if they decide to report later.

Suggestions Specific to Sexual misconduct

Because some evidence dissipates quickly, especially on the body, individuals who have been sexually assaulted should seek medical care immediately. There, they can receive a medical examination and/or have evidence collected.

A person who has been sexually assaulted should avoid showering, bathing, or douching. They should also avoid smoking, brushing teeth, eating, drinking, or changing clothes or bedding before seeking medical attention.

If the individual changes clothes or bedding, they should not wash them. Bring the items to a hospital, medical facility, or police in a paper bag.

In North Dakota, sexual assault victims may have evidence collected even if they do not report to law enforcement.
